These general terms and conditions apply to all reservations
The person(s) entering into the rental agreement will hereinafter be referred to as "tenant(s)".
By reserving the villa Mariposa, the potential tenant indicates that he/she has read and agrees to the general terms and conditions and any deviating or additional conditions.
The prices stated are per week and are final after the reservation has been made by the tenant and a confirmation has been received from the landlord.
Rental periods are weekly and run from Saturday to Saturday unless otherwise stated or agreed.
Villa Mariposa is understood to mean the relevant home with its own grounds and other items such as; swimming pool, outbuildings, inventory and all (movable) property belonging to the relevant home. In some cases, certain areas or outbuildings are closed off to the tenant. These areas are therefore not indicated as rentable on the description of the villa.
2. Arrival and departure
Saturday is the changeover day (unless otherwise agreed with the landlord)
The key to the villa will be in the key safe of the villa. You will receive the code of this safe from us on the day of arrival via text message or whatsapp. Arrival at the villa is after 5:00 PM. You must report to the villa upon arrival (via whatsapp, message or other).
The tenant must leave the house before 9:30 AM on the last day and deposit the key in the key safe.
3. Reservation, booking and payment
The tenant can make a reservation by telephone, in writing or by email/internet (via a reservation platform). The option on the rental agreement is fixed as soon as the correctly completed reservation form has been received by the landlord and this reservation has been confirmed by the landlord. After receipt of the deposit (25% of the rental amount), this option becomes a definitive reservation.
After receiving the booking overview and the deposit invoice, the tenant must pay this within 1 week to the specified bank account number or via the reservation platform where the booking was made. For the remaining 75% of the total rental amount, the tenant will receive the remaining invoice 8 weeks before the start of the rental period, which must be received no later than 8 weeks before the start of the rental period on the same bank account. For the deposit, any other reserved extras, the renter will receive an invoice 2 weeks before the start of the rental period, which must be paid immediately to the same account. If the reservation was made via a reservation platform, all payments will be processed by this reservation platform.
For bookings within 9 weeks before the start of the rental period, the entire rental amount must be paid immediately (For the deposit, any other reserved extras, the renter will receive an invoice 2 weeks before the start of the rental period, which must be paid immediately to the same account). At all times, the total amount due must be received in full by the landlord or the booking platform before access can be granted to the property.
In the event of non-compliance with the payment obligation, the landlord reserves the right to consider the agreement as cancelled.
The tenant will receive the travel documents approximately 2 weeks before the start of the rental period. These include the address of the property, directions, specific agreements and the details regarding the reserved property.
4. Deposit
In all cases, the landlord requests payment of a deposit. The deposit is 400 euros. If the deposit is not handed over/transferred on time, the landlord has the right to refuse access to the property.
Within a few days after his holiday, the tenant will receive a ‘final lease’ overview stating the final settlement. This final settlement states the deposit with the settlement of costs such as: energy, damage, breakage, any last-minute rented items, etc. The tenant must check this final settlement and approve it in writing by e-mail. Provided that the landlord has received approval, the remainder of the deposit will be refunded within 2 weeks after the departure date and will be deposited into the bank account specified by the tenant.
5. Change costs
Any change by the tenant to the booking agreement must be confirmed in writing by the landlord. The tenant will then receive a new booking overview. There are no costs associated with changes to the booking agreement.
6. Additional costs
When renting a villa, the tenant is obliged to have the final cleaning organised by the landlord. The costs in this regard are stated on the website of the villa to be rented. This final cleaning must be paid in cash.
In addition to renting the villa, the tenant can also rent related items. The type and price of these items are stated on the website of the villa as well as on the reservation form. These additional rented related items will be stated on the booking overview.
Related items can also be rented after the reservation of the villa has been made. This does not concern a change to the booking but an addition and will not entail any additional booking costs. The price of these additional items will be charged to the deposit account. If the additions of these related items are ordered after payment of the deposit (e.g. upon arrival at the villa and during the stay in the villa), these costs will be settled with the deposit and will be mentioned on the overview 'end of rental'. It is therefore possible to rent related items on the day of arrival or during the rental period. Payment of these items will be settled with the deposit.
7. Changes / Cancellations
The tenant must always confirm a cancellation in writing (preferably by e-mail and/or via the rental platform). The tenant will receive confirmation of the cancellation from the landlord.
If the tenant is forced to cancel his stay, he can arrange for another, comparable tenant. A new rental agreement must then be drawn up. After assessing this changed reservation, the landlord will send a written confirmation for and to this new rental.
In the event of cancellation up to 12 weeks before the start of the rental period, all amounts paid will be refunded to the bank account specified by the tenant.
In the event of cancellation within 12 to 8 weeks before the start of the rental period, 25% of the total rental amount is due.
In case of cancellation within 8 weeks before the start of the rental period, 100% of the total rental amount is due.
In case of early departure (regardless of the circumstances) from the property rented by the tenant, the tenant must always report this in writing. The total rental amount will then remain due.
It is recommended to take out cancellation insurance and travel insurance
If compliance with the rental agreement by the landlord cannot reasonably be complied with due to important circumstances, the landlord has the right to amend the agreement. Such circumstances occur, for example, in the event of the death of the owner, sale, serious damage to the property or in the event of force majeure as a result of war, strike, natural disaster or exceptional weather conditions. The intended amendment will then mean that the rental amount and deposit already paid by the tenant will be refunded. Liability for any damage suffered by the tenant due to a cancellation made by the landlord will not be accepted by the landlord.
8. Other:
Contact person: There is a contact person in the vicinity of the villa available 7 days a week. The details of this person will be communicated to you in due time at the same time as the travel description.
Number of persons: The rented villa and associated grounds may only be occupied by the persons mentioned in the rental agreement. Only with prior written permission from the landlord is it permitted to invite other persons to a rented villa than those mentioned on the reservation form.
Final cleaning: Having the final cleaning done is mandatory. In addition, the tenant must leave the entire villa broom clean when leaving the villa. There is also a possibility for an interim cleaning. Information about this can be obtained by e-mail.
Household waste: The tenant must ensure the correct storage and disposal of household waste (instructions are stated in the tenant's book).
Inventory: The tenant must treat the villa and the inventory with the utmost care. All damage or malfunctioning (whether or not caused by the tenant) must be reported to the landlord immediately. Failure to do so may result in costs.
Linen: The landlord offers the villa including bath and bed linen. A towel package for 1 person consists of 1 large, 1 small towel, 1 beach towel. A bed linen package for 1 person consists of: duvet cover, fitted sheet for mattress and pillowcase. In addition, a kitchen set is available (dishcloth, 2 tea towels and two towels). There is a possibility for an interim change of linen during your stay. The villa has a washing machine and dryer. Information about changing linen can be obtained by e-mail.
Smoking: Smoking is not allowed in the villa. Any ashtrays present are intended for outdoors.
Tenant book: The villa has a tenant book in which relevant information is listed regarding the rented villa as well as important telephone numbers and other. Personnel: It may be necessary for personnel to have access to the property or grounds during the tenant's stay for regular maintenance or repairs. The tenant will always be informed (with the exception of the pool attendant, the time of this visit can be requested by email) if such a person is coming to carry out work and, if possible, this will be done in consultation with the tenant. Tenants are not permitted to refuse such persons access to the property or grounds. If a person wants to carry out work (or otherwise) on or near the property unannounced, this person has probably not been hired by the landlord and the tenant must contact the landlord immediately.
Internet: The villa is equipped with (wireless) internet (fiber optic), however the landlord cannot guarantee its functioning.
BBQ: all villas have a BBQ available for tenants. It is the tenants' responsibility to ensure safe management of this BBQ. It is also the tenants' responsibility to leave the BBQ and its immediate surroundings clean upon departure (not included in the final cleaning). Failure to comply with this obligation will result in a subsequent invoice of 25.00 euros per BBQ.
Pets: Bringing some pets is permitted. In all cases, bringing a pet, as well as the number and type thereof, must be reported when booking. There is an additional cleaning fee of 35.00 euros per pet that will be charged (stated on the booking overview). The tenant must ensure that pets brought along do not have access to bedrooms and swimming pools and do not lie or sit on furniture. Pets must be walked outside the villa grounds (on a leash and please clean up after themselves). If the tenant has not taken care of cleaning up pet feces on the grounds of the rented property, this will be done by the landlord and the tenant will be charged 50.00 euros for this, which can be deducted from the deposit. If pets are allowed, the main tenant is liable for any damage caused by pets brought along.
Swimming pool: The swimming pools are generally in use all year round. Once a week, an employee of the landlord comes to maintain the swimming pool. This maintenance includes cleaning, checking the installation and water treatment. The day of this maintenance is not always the same, but is known at the office and can be requested if desired. The tenant is not permitted to operate the technical installation of the swimming pool himself. Children under the age of 14 may only use the swimming pool under the supervision of an adult. Even under supervision, children who cannot swim well must wear a life jacket. Pets brought along do not have access to the swimming pool. In exceptional cases, the swimming pool cannot be used due to maintenance or repairs. In the event of accidents and/or unforeseen circumstances (maintenance/repairs), the landlord/owner cannot be held liable.
9. Liability
The landlord accepts no liability for damage, injury or inconvenience to/of the tenant as a result of and/or related to his stay in the villa.
The landlord accepts no liability for: - theft, loss or damage, of any nature whatsoever, during or as a result of a stay in a villa offered;
The landlord accepts no liability for the breakdown or disabling of equipment, errors and/or mistakes on websites or other publications issued by the landlord
Construction activities in the vicinity of the rented villa are not foreseeable by the landlord and can therefore not accept any liability for nuisance caused by construction activities around the rented property.
The main tenant is jointly and severally liable for all loss/damage to the rented property and the associated inventory, regardless of whether this is the result of actions or omissions of the tenant or of third parties who are in the rented property or the associated grounds with the tenant's permission.
The tenant is required to have an AVP (Private Liability Insurance), whereby the landlord assumes that the tenant has this and confirms this by entering into the reservation. The tenant releases the landlord from the obligation to pay compensation to the owner for damage to the villa caused as a result of or during the tenant's stay. The same applies to damage caused by and to be paid to third parties.
If for whatever reason the landlord is liable for damages, the amount of the compensation to be paid is limited exclusively to the amount of the rental sum.
The landlord cannot be held liable for inconveniences or deviations from the home that are not the landlord's fault. If inconveniences and deviations are essential to the agreement and the landlord is to blame, the maximum damage will be limited to the amount of the rental sum.
Accidents in the villa or on the associated grounds can under no circumstances be attributed to the landlord or the owner.
In the event that war, strike or other extraordinary circumstances (the weather) cause the landlord to be unable to fulfil any obligation or to fulfil it in full, the rental agreement can be terminated by them without the tenant being able to claim any compensation.
